Data protection

Based on Article 13 of the Swiss Federal Constitution and the federal data protection provisions (Data Protection Act, DPA), every person has the right to protection of their privacy and protection against misuse of their personal data. I comply with these provisions. Personal data are treated with strict confidentiality and are neither sold nor disclosed to third parties.

Courses and Events — General Terms and Conditions (GTC)

These General Terms and Conditions apply to all therapy services, course offerings and events held at the studio. These General Terms and Conditions have been in effect since January 2017. By registering for an event or a course with art therapist Kerstin Matthews, participants accept the following General Terms and Conditions (GTC) of KT Kerstin Matthews, Obfelderstrasse 31, 8910 Affoltern am Albis. The contract is concluded upon confirmation of the booking by phone, by e‑mail, or upon sending the invoice/confirmation by post or e‑mail by KT Kerstin Matthews. The scope of the contractual obligations is determined by the service description of the respective course and/or the details in the booking confirmation.

1. course content and organisation — the art therapist

Kerstin Matthews offers courses for children, adolescents and adults who enjoy creative activities. Course content and organization are described separately. KT Kerstin Matthews reserves the right to adapt the organization during the course to suit circumstances. The painting courses as well as preparatory and advanced training courses do not guarantee admission to a specialist school. Art therapist Kerstin Matthews specifies the maximum number of participants per course in the course description. KT Kerstin Matthews reserves the right to cancel courses if participant numbers are insufficient. In such a case the course fee will be refunded. With the consent of the participants, an under‑subscribed course may be held; however, the course fee may be increased accordingly. KT Kerstin Matthews reserves the right to make changes insofar as they serve to improve the courses. Content and price changes are therefore reserved.

2. cancellation/termination 

If cancellation/termination of the course becomes impossible, significantly impeded, endangered or made impracticable due to force majeure, security reasons or other causes, the art therapist or persons acting on her behalf may cancel or terminate the event/course. If no replacement date can be found, KT Kerstin Matthews will refund participants their course fee. If an event/course is terminated for the same reasons during its execution, participants will be refunded a proportionate part of the fee. KT Kerstin Matthews accepts no liability for costs incurred by participants as a result of cancellation or termination of the event.

3. cancellation

If an event/course/seminar or individual contract cannot attract a sufficient number of participants, art therapist Kerstin Matthews reserves the right to cancel the event up to 3 working days before the start of the service. This also applies if performance of the contract is impossible or would only be possible with disproportionate effort. Participants will be informed immediately in writing, by phone, or by e‑mail.

MT Kerstin Matthews provides premises and materials.

5. requirements

Prerequisites for course participation: No special knowledge is required.

6. course fee

The course fee for each course is specified in the course catalogue. Payment terms are shown on the invoice.

7. payment terms

By registering for a course, participants commit to paying the course fee. The payment due date on the course fee invoice is binding. Failure to pay the course fee does not count as a cancellation.

8. cancellation

A cancellation must be made in writing. KT Kerstin Matthews reserves the right to charge an administration fee of CHF 150. For ongoing courses a cancellation must be made at least 48 hours in advance. If no cancellation is made and the child or adolescent does not attend the course, the lesson must be paid for.

9. time of cancellation

If the participant withdraws from the contract, the following cancellation fees apply: • up to 20 days before the service start: 50%; • up to 5 days before the service start or in case of non-attendance: 100%; each calculated on the amount paid or owed on the invoice. However, art therapist Kerstin Matthews will accept a replacement participant without additional charges. The start of service is the date and time of the respective course. A withdrawal must generally be made in writing; the decisive date is the receipt of the withdrawal declaration at the business address of art therapist Kerstin Matthews (8910 Affoltern am Albis).

10. missed classes

Missed therapy sessions or course days cannot be made up. For ongoing courses, a cancellation of a session must be made 48 hours in advance. For ongoing courses the contractual provisions communicated in writing to participants via the registration form apply. No course fee will be refunded for missed course days. Only with proof of illness (a medical certificate) may the missed course time be made up in a later course or the course fee refunded.

11. exclusion from the course

Course participants are required to comply with the house rules. KT Kerstin Matthews reserves the right to exclude participants from the course for justified reasons. Participants will receive a written warning for a proven breach of the rules. A second breach will result in exclusion. Immediate exclusion will occur in the case of consumption of illegal drugs and addictive substances before or during the course, as well as intentional disruption of the course. No refund of the course fee will be made after exclusion from a course.

13. disclaimer

By registering, participants confirm that their health permits attendance of the courses without endangering their own health or the course proceedings. Participants and their legal representatives confirm that adequate insurance coverage is in place. Art therapist Kerstin Matthews accepts no liability. This specifically includes liability for accidents, injuries, thefts and other possible damages. Use of the rooms of the painting studio is at your own risk.

14. copyrights

The content (texts and photos) of this website is protected by copyright. Use, modification or distribution without the creator’s consent is not permitted.

15. uncollected/unclaimed paintings, canvases and artworks

 Uncollected paintings, works and artworks created in the courses for children, adolescents and adults will be disposed of after 1 month.

16. invalidity of individual clauses

If any provision of this agreement is or becomes invalid, the validity of the remainder of the agreement shall not be affected. The invalid provision shall be replaced by a provision that, to the extent legally possible, comes closest to the parties’ intent.

17. applicable law and jurisdiction

Swiss law applies to the settlement of all disputes related to the business activities of art therapist Kerstin Matthews.

18. ancillary agreements

This contract, as well as any amendment or rescission of these clauses or of the contract, must be made in writing to be valid.

19. place of jurisdiction

Art therapy individual sessions and group therapy are charged according to the course description. For cancellations made less than 48 hours in advance or for no-shows, the fee will be charged. Missed or non-cancelled sessions will be billed to the client and cannot be claimed from health insurance.
